Mr. Gornish is a member of Caesar Rivise's ANDA Litigation Team. His litigation practice is largely focused on pharmaceutical patent infringement lawsuits arising under the Hatch-Waxman Act. For the last few years, Mr. Gornish has represented generic drug companies in several different lawsuits initiated by brand-name companies upon the generic companies' filing of Abbreviated New Drug Applications (ANDAs) and Paragraph IV certifications. A highly skilled researcher, Mr. Gornish has conducted extensive legal research directed to complex issues that arise in this nuanced and often unsettled area of the law. Additionally, Mr. Gornish has prepared numerous briefs and motions for ANDA cases at both district court and appellate levels and has been involved cumulatively in all stages of different ANDA cases, from pleadings through discovery, trial and appeal. He is registered to practice before the United States Patent and Trademark Office.

In re '318 Patent Litigation (D. Del. 2005), represented one of seven generic manufacturers in ANDA litigation involving the Alzheimer's drug Razadyne®/Reminyl® (galanthamine).

Biovail Laboratories, Inc. v. TorPharm, Inc. (E.D. Pa. 2004), represented generic manufacturer regarding blood pressure medication Tiazac® (diltiazem hydrochloride)

Sanofi-Aventis, Sanofi-Synthelabo, Inc., and Bristol-Myers Squibb Sanofi Pharmaceuticals Holding Partnership v. Apotex, Inc. (S.D.N.Y. 2003), represented generic in ANDA litigation on anti-platelet medication Plavix® (clopidogrel bisulphate)

Biovail Laboratories, Inc. v. TorPharm, Inc. (N.D. Ill. 2003), represented generic manufacturer in suit involving calcium channel blocker medication for hypertension Cardizem CD® (diltiazem hydrochloride)

AstraZeneca AB v. Apotex, Inc. (S.D.N.Y. 2002), represented one of five generic manufacturers in ANDA multi-district litigation for a gastric acid proton pump inhibitor Prilosec® (omeprazole)

Novartis Pharma. v. Apotex, Inc. (S.D.N.Y. 2002), represented generic in ANDA litigation concerning nasal osteoporosis pharmaceutical Miacalcin® (calcitonin)

Apotex, Inc. v. Eon Labs Manufacturing, Inc. (S.D.N.Y. 2002), represented patentee in litigation involving generic anti-rejection medication cyclosporin
